Terms and conditions of sale
Article 1 · Purpose
These terms govern the sale, by the publisher of music-press.com (Patrick Oliveira, sole proprietorship, Switzerland), of online access to a database of music media contacts (podcasts, webzines, radios, blogs, channels, magazines, newsletters, playlists), intended for artists, bands and music professionals wishing to present their music to these media.
The service consists of the online consultation of the records and the revealing, contact by contact, of the contact details. It does not include any export, download or file: the database is consulted within the client area, it cannot be downloaded.
Article 2 · Offer and price
Francophone Pack: 39 € incl. tax, one-time payment, giving access to the media of France, Belgium, Switzerland and Luxembourg present in the database.
The number of media announced on the site corresponds to the media with a verified contact and recent activity as at the date of consultation. It changes over time as verifications and enrichments are made: media may be added or removed when they cease to publish.
Prices include the applicable VAT. The publisher may change its rates at any time; changes apply only to subsequent orders.
Article 3 · Order and payment
Payment is made by bank card via the secure Stripe platform, compliant with the PCI DSS standard. No banking data is stored by the publisher. Payment is due in full at the time of the order. An invoice is sent by email to the address provided.
Article 4 · Access to the service
Access is opened immediately after confirmation of payment. Connection is done without a password, via a single-use code sent to the email address of the order. The email address of the order constitutes the client's identifier.
Access is permanent and includes updates to the database, unless terminated under the conditions of Article 6. It is limited to three simultaneous devices; a connection on an additional device closes the oldest one.
Article 5 · Right of withdrawal and guarantee
The service is digital content supplied without a physical medium, the performance of which begins immediately after payment with the client's agreement. In accordance with the rules applicable to e-commerce, the client acknowledges that the immediate opening of access constitutes the start of performance and waives their statutory right of withdrawal.
"7 days to change your mind" commercial guarantee. Notwithstanding the above, the publisher grants every client the right to request a full refund of their purchase within 7 calendar days following payment, without having to give a reason, by a simple email to contact@music-press.com. The refund is made to the original means of payment within 5 business days. Access is closed at the time of the refund.
Exception: this guarantee does not apply in the event of abusive use within the meaning of Article 6. Such use, from the first breach established, results in the immediate closure of access without a refund.
Article 6 · Authorised use and prohibited uses
Access is strictly personal and intended for the promotion of the client's music or that of the artists they directly represent.
The following are prohibited and constitute abusive use:
- the automated or mass extraction of the data (scraping, robots, scripts, systematic captures);
- the reproduction, resale, transfer, publication or sharing of all or part of the database, whether free of charge or for consideration;
- the sharing of the account with third parties;
- the use of the contact details for unsolicited mass mailings, canvassing unrelated to music promotion, or any use contrary to the law.
The publisher puts in place technical limits (consultation rate, number of devices) and detection mechanisms. It may suspend or terminate without notice the access of a client in breach, without a refund, and reserves the right to take any appropriate action.
Article 7 · Nature of the data and liability
The data gathered comes from public sources (websites, feeds, listening platforms, directories) and is subject to regular verification. The publisher does not guarantee either the permanent accuracy of each contact detail, or the response or coverage of the media contacted, which remain free in their editorial line.
The client can report an invalid address from their area; the publisher verifies it and updates the database. The publisher's liability, in any event, is limited to the amount paid by the client.
Article 8 · Updates and evolution of the service
Updates to the database are included in the access. The publisher may remove a medium, add others, modify the functionalities or appearance of the client area, without this giving rise to any right to compensation, provided that the purpose of the service is maintained.
Article 9 · Personal data
The processing of the client's personal data is described in the privacy policy.
Article 10 · Applicable law and disputes
These terms are governed by Swiss law. For a consumer residing in the European Union, the mandatory consumer protection provisions of their country of residence apply. In the event of disagreement, the parties shall first seek an amicable solution by writing to contact@music-press.com.
